MUMBAI: The Malwani police in suburban Mumbai have booked a former resort owner from Anjuna, North Goa – Moses Bababhai Chudesra and others for rape, gang rape, criminal intimidation, cheating and other sections of the Indian Penal Code (IPC), after a 31-year-old victim accused Chudesra and others, including his family members of promising her marriage, maintaining sexual relations with her for 3 years and then deserting her after her daughter was born.

According to the F.I.R registered at the Malwani police station on Tuesday – a copy of which was accessed by this reporter, the accused Moses Bababhai Chudesra met the victim on Facebook and offered her opportunities to conduct events at a resort he was running or managing along with other partners and investors at Anjuna, near the UV Bar in North Goa.

The victim who was going through a divorce and bad marriage was looking for work and hence when given the offer of conducting events at the Chudesra-run Coastland Cottages at Anjuna took up the offer and went to meet Chudesra.

Chudesra was also married and on the verge of divorcing his first wife according to Muslim Personal Law and marriage norms.

Chudesra promised to marry the victim as soon as her divorce came through and started maintaining sexual relationship with her. When the victim insisted on getting married first and then entering into a physical relationship, Chudesra forced himself on her and raped her. Later on he kept threatening her to reveal the details of their relationship to her husband with whom she was involved in a legal divorce battle.

The victim has alleged that Chudesra broke her mobile phones – which had evidence of their relationship and even clicked private and intimate images and videos of her and later on used them to blackmail her.

For three years, Chudesra maintained sexual relations with the victim and also conducted a sham marriage at Anjuna in Goa, even though the victim was yet to get her divorce. He kept forcing the victim to engage in sexual relations with him and when she became pregnant, he illegally gave away the child to another couple in adoption, the victim’s statement in the F.I.R said.

When the victim became pregnant for the second time, Chudesra tried to force her to abort her pregnancy. He abused and beat her, but the victim went ahead with her pregnancy and gave birth to a girl, the victim alleged in her statement.

Chudesra then threw her out of the house after kicking, beating and humiliating her and refused to accept the child as his own. By this time the victim had got her divorce from her first marriage and insisted upon Chudesra to legally solemnize their marriage and get married before a registrar or though valid religious rites. But according to the F.I.R, Chudesra threatened to kill the victim if she went to the police or complained to any other agency and threw her out of his house.

The accused also allegedly forced the victim under threats to her life to engage in sexual relations with him even when she was pregnant, but refused to marry her legally.

He further refused to provide any financial support to the new born 40-day-old girl child, claiming that the baby was not his own.

Aggrieved by these actions, the victim first approached the Dindoshi Police station – Chudesra now lives with his family at Malad East in suburban Mumbai – but the Dindoshi police refused to register her complaint against the accused on technical grounds. The victim alleged that Chudesra paid off the cops at the Dindoshi police station and hence they refused to entertain her and told her to approach the courts.

The victim then approached a journalist who took her to meet the Deputy Commissioner of Police (DCP) of the Borivli Zone – Vishal Thakur.

According to the victim she is extremely grateful and indebted to the Senior Inspector of Police at Malwani police station, other police officials at Malwani police station and DCP Vishal Thakur of the Borivali Division who listened to her case patiently and promptly registered the FIR.

Speaking to this reporter, the victim said, “were it not for DCP Vishal Thakur sir and Malwani police station Senior PI Shekar Bhalerao sir, my FIR would have never got registered”. The Dindoshi police were bribed by the accused and made me run around 3-4 times and yet no complaint was registered, the victim alleged.

According to police sources, the accused Moses Bababhai Chudesra has several cases registered against him both in Mumbai and Goa and was accused in a drug-bust at Anjuna in North Goa. She alleged that the accused paid of the cops in Goa and got away without any case.

Moses Bababhai Chudesra also owes the owner of the resort more than Rs 30 lakh as well as other vendors and investors with unpaid dues running into huge sums of money.

The victim told this reporter that the accused Moses Bababhai Chudesra has cheated several women by promising them marriage and had sexual relations with them and then dumped them after using and abusing them physically.

Similarly the accused has cheated several businessmen and vendors in Goa, however the cops at the Anjuna police station did not take cognizance of complaints as the accused used to pay them off.

The accused was unavailable for comment or clarifications, in spite of our efforts to contact him. Read more here.
