MUMBAI: The Malwani police registered FIR No. 1581 of 2022 u/s 376, 376 (2)n, 420 and 506 against one Moses Bababhai Chudesra, a resident of Peerubhai compound, near the New Sanjivani hospital at Malad East on the 18th of this month and even 5 days later the accused is roaming freely around Malad, with the cops busy with other matters.

According to the 31-year-old complainant Rose Shetty (named changed to conceal identity), “I happened to pass by his house at Malad East on Saturday night and the accused’s father threatened me with dire consequences. They even threatened me that they will kill me or file theft and extortion cases against me.”

“The police are not taking any action. The Malwani cops only registered the FIR after I met the zonal DCP. Now, they say they have sent the case to the Nasik police. Why can’t they act on the FIR in Mumbai. I live at Malwani. The accused has raped me in Mumbai. For the last 3-4 years, the accused has been raping me continuously on the pretext of marriage at different locations in Goa, Nasik and Mumbai. When I got pregnant, he illegally gave away my first child in adoption, against my wishes. He then promised me marriage and did a sham marriage according to Muslim Ghanchi samaj rites, but I later on found out that the marriage was fake and the man he claimed to be a Maulana was a dummy. I got pregnant for the second time and after I delivered a baby girl, he threw me out of the house, alleging that the child was not his. Now he claims we were never married,” the complainant victim said.

The victim has alleged the cops at the Malwani police station “politely” called the accused to record his statement, but he flatly refused to attend. Till today, nothing has been done in this case. The accused has paid the Malwani cops a whooping amount and they are doing nothing in spite of registering a rape, gang rape, cheating and criminal intimidation case, the victim said, adding that this is the first time in her life she has seen the cops politely invite a rape and gang rape accused to present himself at the police station for recording his statement.
