NCB kept women illegally detained for more than 24 hours, against SC guidelines: Adv Ayaz Khan
MUMBAI: In a series of sensational allegations, senior advocate Ayaz Khan who specializes in NDPS cases has accused the Narcotics Control Bureau (NCB) of illegally detaining women suspects in the middle of the night – which is prohibited by Supreme Court guidelines, as well as detaining them for much more than 24 hours, without producing them before a court.
The law stipulates that any accused who is arrested has to be produced before a court within 24 hours of his/her arrest.

Adv Ayaz Khan who is appearing for Nupur Satija in the Aryan Khan drugs case said his client was detained at around 8 pm on 2nd October 2021 and was produced in court only around noon time on 4th October 2021, which is much more than the stipulated 24-hour period laid down by law. He alleged that Nupur Satija was illegally detained by the NCB for nearly 36 hours, without being produced in a court, which is totally against the law and several Supreme Court judgments.
Further, Nupur Satija was frisked and searched by a third party and not by NCB officials. According to the NDPS Act, under which she was detained and subsequently arrested, only an NCB official is authorized to search her, her baggage or her room/cabin, Adv Khan claimed.
According to Adv Ayaz Khan, Nupur Satija, her baggage and her cabin was searched by a third person, being a security guard of the cruise ship, which is again against the law. ALSO READ: NCB witness K P Gosavi used different addresses on different panchnamas, most probably fake
She was illegally detained for more than 24 hours and not produced in court within the mandatory 24-hour time span. Further, she was detained in the middle of the night, which is not permitted as per Supreme Court guidelines, Ayaz Khan said.
