In spite of Bombay HC order, Malwani cops fail to arrest accused property grabbers

MUMBAI: In a landmark judgement, the Bombay High Court in an order dated 23rd September 2022 by Justice (Smt) Bharati Dangre, set aside the protection from arrest granted to professional property and flat grabbers Mohammed Shoaib Mohammed Zahid Ansari and Rukshana Mohammed Zahid Ansari of Malwani in Malad west area of suburban Mumbai and instructed the investigating officer (IO) in CR No 769/22 under sections 406, 420, 465, 467, 468, 471 504, 506 r/w Section 34 IPC, that he was free and at liberty to arrest the accused (named above) ALSO READ | Rs 200 Cr Fake Property Registration Scam At Malwani, Malad West Exposed

The order was passed in Anticipatory Bail Application no 1869 and 1870 of 2022 and the accused were denied any protection from arrest in the matter by the High Court.

In spite of the clear cut observations and written order by the High Court, instructing and observing that the IO was at liberty to arrest the accused persons in the cheating, fraud and forgery case, the Malwani police are dragging their feet and protecting the accused. ALSO READ: Malwani Cops Favor Broker With More Than 20 Cheating Cases: Do Not Register FIR For 7 Months

According to a social worker Minakshi Shinde, the Malwani police have received a huge bribe amount in this case as it involves a total amount of Rs 17 lakhs, which have been siphoned off by the main accused Sujata Shetty, a real estate broker Waseem Moinuddin Shaikh and the accused above named Ruksana Ansari, and Shoaib Ansari. Shinde has alleged that a sum of nearly Rs 3 lakh was distributed to various officers at the Malwani police station to endorse a fake “Tenant Verification Form” as well as other papers to permit the property grabbers to get possession of the flat and now the officers are protecting the accused from arrest, in spite of directions by the Bombay High Court.

According to the lawyer for the complainant, actress Gehana Vasisth (real name Vandana Tiwari), the police when asked why they were not arresting the accused, said that “the accused deserved to be given some consideration” (Read the full story here).

It is apparent from these statements of the Malwani police officials that they are protecting the accused, Gehana’s lawyers observed, alleging that the High Court orders do not seem to matter for the Malwani police.
