Oshiwara Police fail to appear in Sessions court ABA in Rahul Jain rape case

MUMBAI: Neither the investigating officer nor any other official from the Oshiwara police station appeared in the Dindoshi sessions court in the anticipatory bail (ABA) hearing of singer and music composer Rahul Jain, who has been accused of allegedly raping a costume designer. The Oshiwara police had registered FIR No. 1244 dated 11th August 2022 u/s 376 (rape), 504 (threats) and 323 (causing injury), in which Jain approached the Dindoshi sessions court on 23rd August this year in an ABA praying for bail. The matter came up for admission/hearing today (Friday) but no police officials were present when the case was called out. The absence of the investigating agency in this high-profile case was apparent to the court. According to sources, the investigating officer (IO) of the case from the Oshiwara police station claimed they have not received a copy of the ABA (anticipatory bail application), service of which is mandatory for the applicant, but the advocate for Rahul Jain produced a proof or acknowledgement of the service to the police station.

Rahul Jain’s advocate told the court a copy of the ABA was officially handed over to the police and produced an acknowledgement of the same.

A senior police official said the copy of the ABA must be lying with the dispatch or inward department and must not have reached the IO’s table.
