Miscarriage of Justice: Sheezan Khan does not deserve to stay in jail for so long, Rayya Labib opens up

MUMBAI: Terming Tv actor Sheezan Khan’s incarceration in judicial custody a miscarriage of justice, actor Rayya Labib today opined that the actor did not deserve to stay in jail for so long, in spite of the fact that he was accused of abetment to suicide in the Tunisha Sharma case.

“I have been saying this since the first week of his arrest in December last year. It is his lawyers who have botched up the case. Every under trial is eligible for bail and even though the offence under Section 306 of the Indian Penal Code is Sessions triable and carries a maximum sentence of 10 years, Sheezan is still eligible for bail as a matter of right,” Rayya said.

“His lawyers have totally screwed up. They should have focused on bail. They have filed an application for quashing of the FIR along with a bail application in the Bombay High Court. The court will now hear the quashing application first. Why can’t they focus on getting him out on bail. Getting a Section 306 IPC FIR quashed is not easy as the courts will normally not entertain the accused, unless there is substantial and direct evidence. In case this evidence was available, the trial court (Vasai Sessions court) itself would have granted Sheezan Khan bail. The fact that the trial court rejected his bail application, itself suggests that they was prima facie some evidence in the matter,” Rayya opined.

Sheezan Khan’s bail application is pending in the Bombay High Court along with another application for quashing of the FIR registered against him. In the first week of January, the Vasai Sessions Court in Palghar district of Maharashtra had rejected his bail application on various grounds.
