After Sessions court rejects ABA, singer Rahul Jain moves Bombay HC for Anticipatory Bail in rape case
MUMBAI: Singer and music director Rahul Jain has moved the Bombay High Court, filing an Anticipatory Bail application (ABA), after a Mumbai Sessions court at Dindoshi rejected his bail application earlier this month.
Jain’s ABA was filed in the High Court on 21st September and came on board/was mentioned by his advocates on the 23rd of this month.
It has been adjourned to the 3rd of October for admission before a Single Bench of Justice (Smt) Bharati Dangre.
A Sessions court at Dindoshi in suburban Mumbai had on Sept 7th rejected the anticipatory bail application (ABA) filed by Jain on the grounds that a serious offence was prima facie made out in the F.I.R.
Jain had moved the sessions court for anticipatory bail after a costume designer accused him of allegedly raping her (Read Full Story Here) at his residence at Lokhandwala in suburban Mumbai and registered an FIR at the Oshiwara police station.
Sessions judge A Z Khan (presiding over Court No 9 at the Dindoshi Sessions court who heard the ABA 1356/22) rejected the application after hearing both sides as well as the police and the additional public prosecutor (APP) for the State of Maharashtra, Mrs. Geeta Godambe who strongly opposed the grant of anticipatory bail. Adv Shabnam Latiwala for intervener/victim complainant also pointed out to the court that this is the second FIR against the singer in the last 12 months under similar sections of the Indian Penal Code.
The Oshiwara police had registered FIR No. 1244 dated 11th August 2022 u/s 376 (rape), 504 (threats) and 323 (causing injury), after which Jain approached the Dindoshi sessions court on 23rd August this year in an ABA praying for bail.
The whereabouts of Jain are unknown, he is not available at his Lokhandwala flat and he is untraceable, the Oshiwara police told the court, after which the court rejected the application.
It remains to be seen if the Oshiwara police station will strongly oppose the bail application in the High Court or will Jain manage to secure anticipatory or pre-arrest bail. For the complete updates on this case CLICK HERE
