Sheezan Khan sent to 14 days JC, will have to spend New Year’s Eve in the Thane Central jail or Taloja jail

MUMBAI: Sheezan Khan – the former boyfriend of Tv actor Tunisha Sharma will have to spend New Year’s Eve either at the Thane Central Jail or the Taloja jail as the Vasai court has sent him on a 14-day judicial remand or court custody.

Since the Section 306 of the Indian Penal Code under which Sheezan Khan was arrested is cognizable, non-bailable and non-compoundable. It is also Sessions triable, which means the Magistrate’s court at Vasai cannot grant him bail in this case and his lawyers will have to apply in the Thane Sessions court. This process is likely to take at least 3-6 days, as tomorrow is a Sunday.

After filing the bail application in the Thane Sessions court, the court will call for the ‘say’ of the IO (investigating officer) and arguments will take place. Which means at the earliest Sheezan Khan can expect to be released only by the 4th or 5th of January next year and that too if all goes well.

Sheezan Khan may have to spend another 10 to 15 days in jail

In the intervening days if the police chance upon any crucial evidence in the form of WhatsApp chats, etc., to further implicate Sheezan Khan or prima facie prove abetment, it is unlikely the Sessions court (trial court in this case) will grant him bail and he will have to approach the Bombay High Court, a process that could take another 15 days.

Section 306 of the Indian Penal code has a maximum punishment which could extend up to10 years if proved completely and in such cases the trial courts (Thane Sessions court) do not grant bail if prima facie evidence is available to prove abetment, unless the charge sheet is filed, which means Sheezan Khan could have to spend 90 days in jail or unless the Bombay High court grants him bail.
